Acceptance and operator

These Terms of Use (“Terms”) form an agreement between you and VovenTech (“VovenTech,” “we,” “us,” or “our”) concerning your use of the Kapil Journey mobile application, website, and related services (together, “Kapil” or the “Service”).

If you use Kapil on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes the organization.

Eligibility

You must be legally capable of entering into this agreement. Kapil is not directed to children under 13. If you are a minor where you live, you may use Kapil only with the involvement and permission of a parent or legal guardian where required by law.

You may not use Kapil if you are prohibited from receiving the Service under applicable law or if we previously terminated your account for serious or repeated violations.

What Kapil provides

Kapil provides tools for couples to connect, communicate, preserve memories, answer prompts, plan events, maintain shared lists, track relationship moments, and use other relationship-focused features.

Kapil is a general lifestyle and communication service. It is not therapy, medical care, legal advice, crisis support, or an emergency service. Do not rely on Kapil where professional advice or urgent assistance is required.

Your account

• Provide accurate information and keep it reasonably current.
• Keep your device, credentials, sign-in provider, and account secure.
• Do not share access to your account or impersonate another person.
• Notify us promptly if you believe your account has been compromised.

You are responsible for activity through your account to the extent permitted by law. Authentication may be provided through Apple, Google, email/password, or other methods we support.

Your partner connection

Kapil lets you connect one account to another through an invitation or pairing process. Only connect with a person you know and intend to share a Kapil space with. You are responsible for the information you choose to share.

Do not disclose your partner’s private messages, images, recordings, location, or other content outside Kapil without their permission. A partner connection can expose shared content to both participants, and some shared content may be changed or deleted when either account is disconnected or deleted.

If a relationship or connection ends, review your shared content, disconnect the partner where the feature is available, and contact us if you need account assistance.

Your content

“User Content” includes messages, voice notes, images, videos, memories, answers, reactions, moods, locations, events, lists, expense entries, profile information, and anything else you submit through Kapil.

You keep ownership

You retain ownership of your User Content. You grant VovenTech a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, display, format, and otherwise process User Content only as needed to operate, secure, maintain, and improve the Service, comply with law, and carry out your instructions. This license ends when the content is deleted from our active systems, except where limited retention is permitted by the Privacy Policy or law.

Your responsibilities

You represent that you have the rights and permissions necessary to submit User Content and allow its use as described here. You are responsible for creating your own copies of content you cannot afford to lose; Kapil is not a guaranteed archival or backup service.

Acceptable use

You may not use Kapil to:

• Violate law, another person’s rights, privacy, or intellectual property.
• Harass, threaten, stalk, abuse, exploit, or impersonate another person.
• Share intimate or personal content without the subject’s permission.
• Upload malware or attempt to interfere with, probe, overload, or bypass the Service’s security.
• Scrape, reverse engineer, copy, resell, or commercially exploit the Service except where applicable law expressly permits it.
• Use automated means to access Kapil without our permission.
• Use Kapil for spam, fraud, deceptive conduct, or unauthorized advertising.
• Create or distribute content involving child sexual exploitation or any other seriously harmful or illegal material.

We may investigate suspected misuse and take proportionate action, including restricting content or access, preserving evidence, or reporting conduct where legally required.

Permissions and third-party services

Some features depend on device permissions or services supplied by third parties, such as Apple, Google, Supabase, Expo, Sentry, mapping/geocoding providers, app stores, or your device calendar and media systems. Your use of those services may be governed by their terms and privacy policies.

You control optional device permissions through system settings. Withdrawing a permission may prevent the related feature from working but does not, by itself, delete information you previously chose to save to Kapil.

VovenTech ownership

Except for User Content, VovenTech and its licensors own the Service, including its software, designs, interface, graphics, branding, text, compilations, and other materials. These Terms grant you a limited, personal, non-exclusive, non-transferable, revocable right to use Kapil for its intended purpose.

“Kapil,” the Kapil mark, VovenTech, and related branding may not be used without permission. If you send ideas or feedback, you allow us to use them without restriction or payment, but you are not required to provide feedback.

Changes and availability

We may add, change, suspend, or discontinue features to maintain, improve, or evolve Kapil. We do not promise that every feature will always be available on every device, platform, or location.

We may update these Terms. If a change materially affects your rights, we will provide notice as required by law. Continuing to use Kapil after the updated Terms take effect means you accept them, unless applicable law requires another form of consent.

Suspension, termination, and deletion

You may stop using Kapil at any time and may delete your account through the Profile screen. Account deletion is described in the Privacy Policy.

We may suspend or terminate access when reasonably necessary to protect the Service or others, comply with law, address serious or repeated Terms violations, or respond to security or operational risks. Where appropriate and legally required, we will give notice and an opportunity to appeal or correct the issue.

Sections that by their nature should survive termination—including ownership, disclaimers, liability limits, and dispute provisions—will survive.

Disclaimers

To the maximum extent permitted by law, Kapil is provided on an “as is” and “as available” basis. We do not warrant uninterrupted or error-free operation, permanent storage of content, compatibility with every device, or that the Service will meet every expectation.

Relationship prompts, insights, date ideas, mood features, and other content are provided for general informational and entertainment purposes. They are not professional advice and should not replace qualified help.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

Limitation of liability

To the maximum extent permitted by law, VovenTech and its affiliates, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or opportunities arising from or relating to Kapil.

Where liability cannot be excluded, it will be limited to the greater of the amount you paid VovenTech for Kapil during the 12 months before the event giving rise to the claim or the minimum amount required by applicable law.

These limitations do not apply to liability that cannot lawfully be limited or excluded, including liability for fraud, intentional misconduct, or death or personal injury caused by negligence where applicable.

Applicable law and disputes

These Terms are governed by the laws applicable to VovenTech’s provision of the Service, without overriding mandatory protections available to you under the law where you live. Courts with jurisdiction under applicable law may hear disputes.

Before starting formal proceedings, please contact us and describe the issue. We will try in good faith to resolve it informally. This does not limit any right to seek urgent relief or use a consumer-protection procedure available to you.

If any provision is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a reorganization or transfer of the Service, subject to law.
